Abstract:

This research provides a comparative examination of the legal frameworks that controls stem cell patents in various jurisdictions. With enormous potential for advancements in medical care and innovation, stem cell research has come to light. However, there are difficult legal and ethical issues  raised by stem cell patentability. Through an analysis of the legal frameworks in the US, Europe, and India, among other nations, this study seeks to clarify the disparate strategies and regulatory frameworks controlling stem cell patents. The analysis provides a thorough review of the legal structures by including important legal concepts, significant cases, legislative laws, and ethical issues. The study aims to provide policymakers, researchers, and stakeholders involved with the field of stem cell research and innovation with a more comprehensive understanding of the ethical and legal quandaries related to stem cell patenting through this comparative analysis.
